CSC to Quisumbing: Reinstate 2 department heads
The Civil Service Commission (CSC) in Central Visayas has ordered Mandaue City Mayor Gabriel Luis Quisumbing to reinstate two department heads whom he reassigned to another division.
CSC-7 Director Editha Luzano issued separate resolutions dated August 17 on the appeal filed by Mandaue City Human Resource Management Officer (HRMO) Damaso Tumulak and Assistant City Engineer Andres Suson following a reassignment memorandum issued by Quisumbing on May 21 this year.
“Pursuant to existing Civil Service Laws and Rules, Quisumbing is hereby directed to immediately stop the implementation of the assailed May 28, 2018 Memorandum, and instantaneously restore Tumulak and Suson to their original stations,” read the CSC order.
Quisumbing was also directed to submit the certified copies of the pertinent records relative to the reassignment of Tumulak and Suson, with his comment to the instant appeal, within 10 days from receipt of the order otherwise the instant case will be resolved based on available records.
Tumulak and Suson sought to invalidate the mayor’s memorandum, saying it’s “unjustified and violative of the pertinent provisions of the 2017 Omnibus Rules on Appointments and Other Human Resource Actions.”
Pending appeal, they also requested CSC to hold in abeyance the reassignment order and to allow them to report to their respective offices and assume their duties and functions as the duly appointed officers.
The commission found the instant appeal in compliance with the requirements stipulated under the 2017 rules on CSC’s administrative cases.
Section 13, Rule IV of the 2017 ORAOHRA provides that the aggrieved party may appeal the reassignment order within 15 days upon receipt thereof to the Commission or CSC Regional office with jurisdiction, as provided under specific law, if he or she believes that no justification for the reassignment.
“Pending appeal, the reassignment shall not be executor. The decision of the CSCRO may be further appealed to the Commission within 15 days from receipt thereof,” read the resolution.
The CSC Field OfficeCebu North is also directed to monitor the implementation of the resolution and submit a report on the city government’s compliance.
Tumulak was assigned to lead a task force and Suson, a former member of the Office of the Building Official, as his assistant.
The Mandaue City government created a special task force that oversees rehabilitation of the Umapad dump site after a team from the Japan International Cooperation Agency (JICA) reportedly found methane deposits in the area.
The task force, Quisumbing earlier said, is necessary because the Department of General Services, which used to oversee the dump site, cannot cope with the problem.
