No bail for 2 suspects in murder case
Two men, who allegedly conspired in killing a 15-year-old boy, are facing murder charges before the court.
No bail was also recommended for the suspects—Clint Payusan of Sitio Banawa, Barangay Guadalupe and James Sabejon of Barangay Busay, both in Cebu City.
"The overt act of the assailants in shooting casually the victim is a clear manifestation...and cold-blooded plan and determination to kill Pierce (Ulibas). With the foregoing unrebutted facts, the undersigned finds probable cause that the crime of murder was committed and that respondents, in conspiracy with each other, are probably guilty thereof, and should be held for trial," read the resolution penned by Prosecutor II Maria Lourdes Bragat-Quilitorio.
Quilitorio has found probable cause to hold the suspects for trial.
In her sworn-statement, Ulibas’ girlfriend said she witnessed the shooting on February 1 this year at around 11:30 p.m. in Nivel Hills, Busay.
The girlfriend and Ulibas were drinking at their friend’s chicken stall when they noticed Sabejon passed by the area several times.
Thereafter, two men onboard a black motorcycle stopped in front of them and the backrider, without hesitation, pulled a gun and shot the victim several times, said the girlfriend. The backrider was later identified as Payusan. Two days prior to the shooting incident, the girlfriend said Ulibas’ fraternity group, Tau Gamma Phi, had a conflict with members of the Alpha Kappa Rho (Akrho).
Sabejon is reportedly a localAkrho president. The girlfriend said she heard Sabejon threatened Ulibas and his group, saying “gusto diay mo og patay ha. Bantay lang mo.”—
