David asks SC to reconsider DQ

Defeated senatorial candidate Rizalino David yesterday asked the Supreme Court (SC) to reconsider its earlier decision favoring the Commission on Elections ( Comelec) that declared him a nuisance candidate in the May presidenti­al elections.

David also asked the SC to issue a temporary restrainin­g order (TRO) or a preliminar­y injunction and reverse the Comelec’s Jan. 12 decision.

David argued the grounds used by the Comelec to disqualify him in the presidenti­al race are not a requiremen­t under the Constituti­on.

“The SC should have cited a clear jurisprude­nce and not dismiss it just because it is within the authority of the Comelec. The Comelec said that it only disallowed us to run just because we did not have enough funds, when in fact having funds is not a requiremen­t under the Constituti­on,” he said.

David though admitted his request before the SC might be regarded as a “tall order” because Comelec had started printing the ballots.

According to David, he could wage a nationwide campaign, saying he was endorsed by several groups that promised to finance his political campaign.

“The respondent Commission (Comelec) was duly notified of the support of these groups but it did not take this into considerat­ion in making its assailed decision,” he said.
