When the party is no longer unable to pay fees during the hearing of the lawsuit or during the execution thereof, the court may cancel the exemption. This cancellati­on of exemption shall stay proceeding­s until the stated fees are paid. If the litigant who is exempted from fees dies, the exemption shall apply to his heirs or any person who replaces them, unless the court deems otherwise.

According to Article 554, if the judgment has ordered the exempted litigant to pay fees, the Registry of the court shall collect the fees. In the case of failure to collect fees, the Registry may reclaim these fees if he is no longer unable to pay. No copy or summary or certificat­e or translatio­n of any lawsuit or of any schedule or record or file or of any paper shall be given until after the fees due on the case or the original copies of papers are collected, unless the applicant of such a copy is the defendant and the claim was dismissed in his favor.

A relative fee of half of a percent shall be imposed of the value of cash, negotiable instrument­s and jewellerie­s which are deposited in the treasury of the court. This value shall be calculated in relation to deeds according to their price at the time of deposit. A fixed fee of QR100 shall be imposed if the deposited good is of unknown value. Fees shall include the minutes of deposit and a copy thereof. The summons of minutes of deposit shall be subject to the due fee.

No deposit fee shall be imposed on the following: (1) Property collected by the execution officers in execution of judgments for the account of receivers; (2) Amounts of money deposited by bidders of the value of real property; (3) Funds deposited by agents of creditors to the account of bankruptcy; (4) Funds deposited by the government authoritie­s to the account of concerned parties. If there is a dispute in the deposit or attachment on the deposited goods or division thereof, a deposit fee shall be paid. No relative fee shall be paid for transactio­ns submitted to the Registry of the court at the expense of amounts deposited at the treasury of the court.

As per Article 563, with exception to notices served within claims that are deemed necessary for execution, a fee of QR 5 shall be imposed on notices served during the course of the lawsuit upon a request made by litigants or for reasons attributed to them. Half of this fee shall be imposed on each paper taken of copies of these notices. This fee shall not be imposed on notices of memorandum­s ordered by the court, or notices of resumption of the course of lawsuit which was suspended due to death or change in capacity of the litigants or notices served upon a request made by the Registry of the court. All expenses required for the service of papers abroad shall be collected from the applicant.

The relative fees imposed on judgments and orders shall be estimated as per the value upon which the execution is requested, if it has known value. However, if it has unknown value, a fixed fee shall be estimated. Fees imposed on the execution of orders of arbitrator­s and judgments of foreign courts shall be estimated according to what has been ruled on the day when these orders of execution are issued.
