Erika Jayne is splitting from her husband, attorney Tom Girardi, after 21 years of marriage.

According to legal documents, the 49-year-old American singer and “The Real Housewives of Beverly Hills” (RHOBH) celeb filed for a dissolution of marriage from Girardi, 81, on Tuesday. In 2017, TV personality Jayne revealed that she and her lawyer husband did not have a prenuptial agreement.

“Let me tell you something, let me be very clear. I’m married to a very powerful lawyer. A prenup wouldn’t stand in his way anyway. It’s gonna be all Tom’s way, I assure you. He’ll rip that piece of paper to shreds in two seconds,” she said.

The couple first met at Chasen’s restaurant in West Hollywood where Jayne used to work serving cocktails and Girardi was a frequent patron. “After a year of working in the restaurant, one night I decided to slip Tom my telephone number,” Jayne wrote in her 2018 memoir. According to E! News, Jayne only decided to marry Girardi after much consideration.

The pair wed in 1999, and despite the decision to split Jayne said she still had “great love and respect for Tom and for our years and the lives we built together.” Jayne has complained on RHOBH that she had got tired of people pointing out the large age gap between her and Girardi.

She said: “I mean, I’m tired of having to justify my 20-year marriage. Go get a 20-year marriage, then come and talk to me.”

In her book, “Pretty Mess,” she said: “It was always a bigger deal to everyone else than it was to either of us. All a couple really needs is to have the same life philosophy. If you see things the same way, then age, race, religion — none of that comes into play. I have a thirst for knowledge and Tom has a wealth of it. He is a great mentor, a great teacher and somebody I really admire … That kind of stuff is a powerful aphrodisiac,” she added.
