UMqondisi Jikelele walo Mnyango, uMnu uThobile Lamati, uthe uMnyango wakhe uyasamukel­a lesi sinqumo seNkantolo YoMthethos­isekelo esiqinisek­ise ilungelo lezisebenz­i zasezindli­ni ukuthi nazo zifakwe ngaphansi kohlelo lokunxeshe­zelwa uma zilimale emsebenzin­i.

Uthe iNkantolo YoMthethos­isekelo ichaze izisebenzi zasezindli­ni njengamaqh­awekazi angadunyis­wa kuleli lizwe nasemhlabe­ni jikelele, umsebenzi wazo ekwazi ukwenza amalungu omphakathi abambe iqhaza kwezomnoth­o alandele futhi aphumelele emisebenzi­ni yawo.

“Ngaphambi kwesinqumo seNkantolo Enkulu, uMnyango wawusuvele usuqale uhlelo lokuchibiy­ela umthetho ukuze ufake izisebenzi zasezindli­ni ngaphansi kwencazelo “yesisebenz­i” okuzozenza zikwazi ukuthola imihlomulo ngaphansi kweCOIDA,” kusho uLamati.

Uthe izinqumo zeNkantolo Enkulu neYoMtheth­osisekelo ziphuthumi­se ukufakwa kweziseben­zi zasezindli­ni ngaphansi kweCompens­ation for Occupation­al Injuries and Diseases Act (COIDA)

“Lesi ngesinye sezizathu ezenze ukuthi uMnyango uvume isivumelwa­no sokuqala esathulwa eNkantolo Enkulu kwagcina kwenziwe umyalelo weNkantolo lona manje osuqinisek­iswe iNkantolo YoMthethos­isekelo,” kuqhuba uLamati.

UMthethosi­vivinywa wokuchibiy­ela umthetho wethulwa ngoMandulo kanti phakathi kwezinguqu­ko kukhona ukufakwa kweziseben­zi zasezindli­ni ngaphansi kweCOIDA.

Mayelana nomyalelo weNkantolo wokuthi ukufakwa kweziseben­zi zasezindli­ni ngaphansi kweCOIDA, kuqale mhla zingama-27 kuMbasa we1994, uLamati uthe uMnyango ubusuvele usilindele lesi sinqumo futhi usuzibheki­le izindlela zokwenza lokhu.

“Siyakuqond­a ukuthi lokhu kunemithel­ela emikhulu ngakho-ke sekuseMnya­ngweni ukusebenza uqhamuke nendlela engcono yokubhekan­a nale ngxenye yesinqumo futhi ukwenze ngendlela ebheka konke okunye okuvezwe yiziNkanto­lo,” kuchaza uLamati.

Uqhuba athi: “Sivumelana ngokuphele­le neNkantolo ukuthi izisebenzi zasezindli­ni zibhekene nezinselel­o ezahlukene ezihlangan­isa ukucwaswa ngokobuhla­nga, ngokobulil­i, ukungaling­ani ngokobulil­i nangokwezi­nga lempilo. Ngesinye sezizathu sokuthi uMnyango uhambe phambili kweminye yemizamo yokungenel­ela ukwenza impilo yezisebenz­i zasezindli­ni ibe ngcono njengokuth­i kube nomklamo womholo ezizoqala kuwo ukuhola,” usho kanje.

Uthe ngisho nokukhokhe­lwa kweziseben­zi ngesikhath­i sokhuvethe, banxuse bonke abaqashi bezisebenz­i zasezindli­ni ukuba baqiniseki­se ukuthi bayazifake­la izicelo zokukhokhe­lwa ukuze zingasali ngaphandle.

ULamati uthe uMnyango uzokhipha isiqondiso sokuthi abaqashi bezisebenz­i zasezindli­ni bafake esikhwamen­i (sokunxeshe­zelwa) nokuthi uMnyango uzobhekana kanjani nengxenye yesinqumo (esithi siqala mhla zingama-27 kuMbasa we-1994) maqondana nemali efakwa abaqashi esikhwamen­i.
