Intabamlilo ebikade ibila kubukeka izodubula kungekudala. Lokhu kulandela umhlangano waMakhosi kaZulu obubanjelwe eThekwini kusuka izolo. Lo mhlangano obuhlelwe yiIngonyama Trust Board (ITB) ubuhanjelwe ngaMakhosi aseNdlunkulu, aMabamba nezinduna. Phakathi kwaMakhosi abekhona bekukhona uNdunankulu kaZulu, uMntwana waKwaPhindangene kanye neNkosi yaseMadungeni, iNkosi uChiliza enguSihlalo weNdlu Yabaholi boMdabu kweleNdlovukazi uMthaniya. Khona kulo mhlangano bekukhona nohlaka lwezinduna obelumelwe yiNduna uMakhanya.
Phezulu eqhulwini kulo mhlangano yimithetho ethinta ukuphathwa komhlaba phakathi kwayo okubalwa iMunicipal Property Rates Act, i-Upgrading of Land Tenure Rights Acts,iSpatial Planning and Land Use Management Act neCommunal Land Rights Act.
Le mithetho yonke inemiphumela yokubeka umhlabathi woBukhosi engcupheni. Umthetho olawula ukukhokhwa kwentela yomhlaba (Municipal Property Rates) igunyaza omasipala ukuthi bakhokhise abanikazi bomhlaba intela uma nje belandele inqubo ethile.
Ngokulandisa kwe-Ingonyama Trust Board ngokwazi kwayo akukho nowodwa umasipala olandela umthetho olawula lesi simo. Ngaleyo ndlela le mali okuthiwa ikweletwa yiNgonyama Trust ayikho. Elandisa elaboHlanga kulokhu uSihlalo
Webhodi uMehluleli uNgwenya ubeke kanje:
“Ngokuhlaziya kwethu lo mthetho olawula ukukhokhwa kwamareythi kunezinto eziningi omasipala okumele bazicubungule. Eqhulwini kulokhu ukuqinisekisa ukuthi umhlaba abathi iTrust ikweleta kuwo amareythi awunabo yini abanye abantu abanamalungelo okuhlala ndawana thizeni. Uma ngabe bekhona phela labo bangabanini bempahla njengoba kulandisa umthetho.”
Kulo mhlangano kuvele isamba semali esifunwa ngomasipala abehlukene kweleNdlovukazi uMthaniya. ITheku lifuna isamba semali eyizi-R36 396 605.19.
Lesi samba sifuneka kulezi zizwe ezakhele le mikhandlu yoBukhosi, kwaVumazonke, k wa Vuma ngazi, e So bo nakhona Makhanya, E mbo, kwaToyane, kwaMapumulo, naseSimahla. EJozini kwaMyeni/ Nsinde uMasipala ufuna izi-R13 217 367.62.
“Bangama-27 omasipala abashishibeza iNgonyama Trust, isiyonke imali abayifunayo ingaphezu kwezigidi ezingamakhulu amane, namashumi ayisishagalombili nesishagalombili. Seziqalile izingxoxo noCogta esikhundleni somasipala abathi sinecala,” kusho uMtimande.
UNdunankulu kaZulu ethula inkulumo utuse ubunye baMakhosi ekubhekaneni nezinselele ezikhona. Khona lapho uncome kakhulu ibhodi le-INgonyama ngokubiza umhlangano ngokushesha odabeni olumqoka njengomhlaba woBukhosi:
“Siyabonga ukuba uMhlonishwa uMtimande neBhodi ye-Ingonyama bameme umhlangano onjengalona kungakapholi namaseko. Wenze into abefanele ukuyenza ngoba emva kwalezi zigemegeme ezisiveleleyo njengesizwe bekufanele umhlangano onjengalona ubekhona kusashisa nje. Izwe leNgonyama yilo esingaMakhosi ngenxa yalo. Sonke siyazi ukuthi nxa kukhothama nje iNkosi, noma ngingasho iSILO, abantu bafisa ukwazi ingabe ngubani ozophatha izwe. Kusuke kushiwo lona leli leNgonyama esiliphetheyo.”
UMntwana uqhubeke wathi: “Kuyo yonke-ke le minyaka iNgonyama (OMdala) bekuyiyo esiholayo nesikhombisa indlela. INgonyama ibingumkhuseli nomvikeli wezwe. Yingakho lokhu okusivelele ukuba asishiye kunyakazise amathemba neqholo ebesinalo nxa esaphila ehamba phambi kwethu. Ngenxa yobukhona bakhe besazi ukuthi nxa yena esaphila njengoHlanga LoMhlabathi ukuthi izwe lethu lisalokhu liphephile emanketshaneni. Ukungabi bikho kwakhe nje namuhla phakathi kwethu okungokokuqala kubuhlungu kakhulu ezinhliziyweni zethu. Nokho-ke singaphelelwa lithemba ngoba thina sizwe sakhe, thina mpi yakhe sisekhona. Okhokho bethu nobabamkhulu balilwela balifela leli lizwe.
“Ngokuholwa nguSimakade thina Makhosi aseNdlunkulu sizoqhubeka nokwenza umsebenzi wesizwe ebesiwenza ngaphansi kwakhe. Izwe leli esiliphethe Makhosi kasiqhubeke siliphathe njengoba obabamkhulu nobaba babevele beliphethe. Siliphathe
ngalobo buhlakani esabuncela kubazali bethu nabo bebuncele kubazali babo. Siliphathe ngendlela enobulungiswa lobo ababeliphethe ngaphambili ababeliphethe ngabo. Siliphathe ngendlela engenawo ugcobho wenkohlakalo, obabamkhulu nobaba kabazange badayise ngalo nxa umuntu ecela inxiwa. INkosi uChiliza ikhuluma nelaboHlanga ithe: “Sihlangene lapha ngenhloso yokubhunga ngale nsambatheka nentimbothi ekhulunywa ngomhlaba woBukhosi. Lingawa licoshwe zinkukhu, ngeke sivume ukuba kugitshelwe emiphakathini ehlwempu engaphansi koBukhosi. Thina sasithi ukufika kwedemokhrasi kusho ukwamukeleka kwemiphakathi yasemakhaya nangendlela ephila ngayo. Lena yimiphakathi engenayo ngisho imali yokuthenga impuphu namuhla sekuthiwa ayikhokhe amareythi,” kusho uMdunge.
INkosi yaseMadungeni ithe njengaMakhosi balindele noma yini: “Silindile lonke uhlobo lwempi ukuvukela umhlaba woBukhosi. Sikulindele ukuya nasenkantolo.”
Induna uMakhaya egameni lezinduna ithe bayawaseka aMakhosi kulolu daba, wathi futhi bami ne-Ingonyama Trust ngoba yibo njengezinduna abayisandla sokuphosa saMakhosi uma kufika ezindabeni ezithinta ukwabiwa komhlaba.
“Sinxusa ubunye bazo zonke izinhlaka zoBukhosi, ukuba kube nokusondelana kwezinduna naMakhosi kuvikelwe inhlabathi nemiphakathi yasemakhaya,” kusho uMakhanya.

Lokhu kukhuluma “ngemikhuba” yokugwamanda i-Ingonyama Trust kudala, kuqale neSILO esidala sake sayiphatha. Ukutshengisa ukuthi Ongangenzwe Lakhe wabe esenalo ulwazi lalokho okuhlelwayo, wamangaza abaningi eMgubhweni WeLembe kwaDukuza ngonyaka wezi-2014 lapho ethi: “Sesiyazi ngemihlangano ehlelwe lonke izwe leli edingida ngesicelo sikaZulu esisisodwa. Siyazi futhi ukuthi kumunyungwa umkhankaso wokunxenxa amaqembu ezombusazwe ePhalamende ukuthi achibiyele umthetho noma kuqedwe iBhodi le-Ingonyama Trust engiwuSihlalo walo,” kububula iMbube yomhlaba.
Ongangezwe Lakhe waqhubeka wathi labo abanale micabango, yokuqeda Ingonyama Trust, ngabantu abangamfiseli okuhle uZulu, nowathi kuhle ukuba uZulu ubuze imibuzo enqala. “Akuyona imfihlo ukuthi uZulu akalutho ngaphandle komhlaba, ngakho kulilungelo lakho ukuthi mhlawumbe ungakavoti nje ulibuze iqembu lakho olithandayo ukuthi liyakuthanda yini wena njengomZulu. Libuze iqembu lakho ukuthi licabanga ukuthi kuyakufanela yini ukuba nomhlaba, lo esithi uma siphumelela isicelo sethu, esiyoba nawo njengesizwe noma lithi umuhle uhlala emaweni kuze kube ngunaphakade.”
Umlando uyoziphinda
Uma udaba lugcina luphelela ezinkantolo kuyobe kungaqali ukuthi umthetho wezwe uphambane nalokho okuyinqubo yoBukhosi. Ngonyaka wezi-2006 uHulumeni wakha umthetho owawubizwa ngokuthi yiCommunal Land Rights Act (CLaRA) nokho emuva iNkantolo YoMthethosisekelo yawuchitha uCLaRA yathi kawuhambisani noMthethosisekelo. Kukhona inkolelo ethi lokhu okuphakanyiswa ngamalungu e-ANC yimizamo yokulungisa amaphutha ayebonakala kuCLaRA, nokho umbuzo kwabanye nxa kunjalo, pho yenzeni i-Ingonyama Trust?
Emveni kokuba uMehluleli Omkhulu ngaleso sikhathi, uMehluleli uSandile Ngcobo esecubungule izimiso zeCLaRA wathola ukuthi kungebalekelwe ukuthi izimiso eziningi zeCLaRA zithinta, ikakhulukazi, umthetho wesintu kanye nobuholi bomdabu – okuthinta ukusebenza kukazwelonke kanye nokwesifundazwe.
Uthole nokuthi iCLaRA iqhubusha umthetho wesintu ophilayo okuyiwona olawula ukuhlala, ukusebenza kanye nokuphathwa kwendawo yomuntu wonke. Ibuye iqhubushe izikhungo okuyizona eziphethe izindaba kanye nemithetho ehambisana nazo. Ubuye wathola ngokufanelekile ukuthi iPhalamende lilandele umgudu okungeyiwo ekusunguleni iCLaRA.
Ukucabangela ukulungisa okufanelekile uMehluleli Omkhulu uNgcobo ukugcizelele ukuthi uMthethosisekelo uhlinzeka umgudu osemthethweni, lowo mgudu kufanele ulandelwe ngokukhululekile.
Ukusungula umthetho othinta izifundazwe ngokulandela umgudu ohlinzekwa iSigaba 76 okuyingxenye eyinqubo yokwakhiwa komthetho okuhlobene nomthetho okuthinta kabanzi izifundazwe. Uthi ukwehluleka ukuhambisana nezidingo zeSigaba 76 kwenza umthetho osungulwayo ungasho lutho. Ngokufanelekile uthole iCLaRA ingasungulwanga ngokoMthethosisekelo futhi ongasho lutho ngenxa yokungahambisani nezinqubo ezibekwe eSigabeni 76 soMthethosisekelo.
UMntwana waKwaPhindangene weluleke aMakhosi ngobumqoka bodaba lomhlaba kuZulu nakwenzinye izizwe eNingizimu Afrika:
“Udaba lomhlaba weNgonyama akusilo udaba oluthinta thina sodwa njengoZulu kodwa luthinta uBukhosi bonke, bezizwe zonke ezimpisholo eNingizimu ne-Afrika. Okwenzeka lapha KwaZulu akusoze kungabi nawo amachaphazelo nakwezinye izingxenye zaleli lizwe. Njengoba sesingaphansi kweSILO iNkosi uMisuzulu Sinqobile kaZwelithini kaBhekuzulu kaSolomon kaDinuzulu kaCetshwayo kaMpande asizimisele ngawo onke amandla esinawo ukuvikela lo mcebo wabantu bakithi – izwe loBukhosi bukaZulu. Asazi Makhosi ukuthi akekho futhi omunye ngaphandle kwethu, ngaphansi koholo lweNgonyama yethu nangendlela izwe lethu elilawulwa ngayo yimithetho yezwe lakithi.”
