Registrar’s bid for reinstatement delayed
THE Labour Court yesterday postponed until Friday an application for reinstatement by ousted Department of Labour registrar Johan Crouse.
Labour Minister Mildred Oliphant fired Mr Crouse last month on allegations of gross insubordination after he allegedly failed to “brief” her that he had lodged a court application to place the faction-riddled chemicals union Ceppwawu under administration because of its shambolic finances.
He is challenging his removal in the Labour Court.
Advocate Sibongile Nxumalo, for Mr Crouse, told the court his client had suffered prejudice and “reputational” damage as a result of his removal from his post. He argued that the minister was interfering with the work of the registrar and compromising the independence of his office.
Mr Nxumalo said the matter should be heard urgently and his client be reinstated so he could preside on the Ceppwawu matter tomorrow. The court’s postponement means Mr Crouse will not be able to preside over the matter, should it go ahead.
Attorney for the government Themba Skhosana said Mr Crouse’s removal would not affect the Ceppwawu case as an acting registrar had been appointed. He denied that the minister was interfering in the registrar’s functions.
Ms Oliphant also said she held no brief for Ceppwawu, as alleged by Mr Crouse, and that her actions were aimed at maintaining “labour peace” in the country.
“Although (Mr Crouse) may not have been served with any charges at the time of this affidavit, it is the intention of the department to bring charges against him for, among others, gross insubordination. Currently, the matter is under investigation. Once charged (he) will be able to submit evidence in his defence at a disciplinary hearing,” she said in an affidavit.
