Westinghou­se appeal granted

THE SUPREME Court of Appeal (SCA) yesterday granted an appeal by Westinghou­se over a decision by embattled Eskom to award a contract worth R4.3 billion to rival Areva for the replacemen­t of six steam generators at Koeberg power plant. The court reversed the decision by the Gauteng High Court that had dismissed an applicatio­n for a review by Westinghou­se. The SCA found the process followed by Eskom was procedural­ly unfair. After being informed its bid was unsuccessf­ul, Westinghou­se immediatel­y sought an urgent interdict to stop Eskom and Areva from concluding a contract. – Wiseman Khuzwayo
