No reason for Giba to stay in her home
MAUREEN Giba, wife of Eastern Cape estate agent Boy Boy Giba, has failed to persuade the East London High Court to let her to stay in her Beacon Bay mansion.
The Gibas both face charges in the East London Regional Court in connection with the sales of houses without the owners’ knowledge.
Maureen Giba also faced action in the East London High Court to compel her to vacate the Beacon Bay home because it was part of her insolvent estate.
The trustee appointed to manage her estate, Andrew Paterson, told the court that judgment had been given in 2011 for her eviction.
“[Maureen] continues to unlawfully occupy the property, thereby obstructing putting into effect the sale of the property,” Paterson told the court.
“Furthermore, the property continues to depreciate in value due to the fact [Maureen] has failed and/or neglected to effect any repairs towards the upkeep of the property, which is deteriorating rapidly.”
In response, Giba said her estate was placed under voluntary sequestration in April 2010.
She said it was a result of “unknowingly” finding herself in difficult circumstances because of property transactions handled by Mark Yazbek of Yazbek Attorneys.
She conceded an eviction order was granted in 2011 but her attorneys had noted an appeal and the matter was moved to the high court, which had also ruled against her.
Judge Irma Schoeman said it was clear that there was no proper notice of appeal filed in the Grahamstown High Court against the 2011 eviction order. —
