Tenant faces eviction for R175 000 debt

AN ALICE doctor is trying to evict a tenant from his property in East London for failing to pay rent.

Dr Naveed Anjum has instituted legal proceeding­s against Nontobeko Mazibuko for allegedly failing to pay rent at the Southernwo­od property she is leasing from him.

According to Anjum, the contract on July 25 2013.

In his court papers, Anjum alleged that Mazibuko defaulted in her rental amount due and despite his demand, she refused to pay.

The court papers did not state when Mazibuko, who has not filed responding papers, allegedly started defaulting on payments.

“[Mazibuko] remains in unlawful occupation and fails to pay rent. The arrears have escalated to R175 778.61 by July 2015,” Anjum said.

He alleged that Mazibuko had occupied the property for at least six months before he instituted the claim in court, even though the written lease was lawfully cancelled more than a year ago due to non-payment.

Judge Lusindiso Pakade, sitting in the East London High Court, called upon Mazibuko to appear in court and explain why she should not be evicted from the property. She is due to appear on December 8.

Meanwhile, Mziwoxolo and Pricilla Ntwendala have been given marching orders to vacate a Greenfield­s home. Jamshid Farahbakhs­h bought the house at a sale in execution for R635 000 on March 27 this year.

Because Farahbakhs­h lives in Jeffreys Bay, he asked an agent to attend to the property.

On his behalf, the agent made an offer to the Ntwendalas to allow them to live in the house rentfree until the end of May this year.

They offered to buy the house back from Farahbakhs­h but that has not happened. Judge Pakade last Thursday ordered their eviction from the house.

Pakade said they had ten days to vacate the premises after being served with the eviction order. It is not clear if the order has been served.

Failure to do so will result in the sheriff having to get involved in the eviction. The Ntwendalas have also been ordered to pay the costs of the applicatio­n. —
