No free-for-all on Covid compensation
THE DEPARTMENT of Labour in the Northern Cape has clearly stated that Covid-19 compensation is not a free-forall.
This follows a form sent out by the department which apparently created the impression that anyone who tested positive for Covid-19 can claim for worker compensation.
Spokesperson for the department, Kebalepile Khula, indicated that the Compensation Fund is not accepting applications from members of the public unless an employee has been injured or contracted a disease, including Covid-19, in the workplace or in the line of duty.
“There is not a free-for-all in the fund. The Compensation Fund Process claims submitted by employers to the fund are in relation to injuries sustained by employees whilst on duty, and a disease contracted by employees whilst on duty,” Khula said.
He explained that the mandate of the Compensation Fund is derived from Section 27(1) (C) of the Constitution of the Republic of South Africa.
“The Compensation Fund is a Schedule 3A Public entity of the Department of Employment and Labour. The fund administers the Compensation for Occupational Injuries and Diseases Act No 130/1993 as amended by the Compensation for Occupational Injuries and Diseases Act No 61/ 1997,” he added.
He said the main objective of the Act is to provide compensation for disablement caused by occupational injuries or diseases sustained or contracted by employees or for death resulting from injuries or disease, and provide for matters connected therewith.
