No free-for-all on Covid compensati­on

THE DEPARTMENT of Labour in the Northern Cape has clearly stated that Covid-19 compensati­on is not a free-forall.

This follows a form sent out by the department which apparently created the impression that anyone who tested positive for Covid-19 can claim for worker compensati­on.

Spokespers­on for the department, Kebalepile Khula, indicated that the Compensati­on Fund is not accepting applicatio­ns from members of the public unless an employee has been injured or contracted a disease, including Covid-19, in the workplace or in the line of duty.

“There is not a free-for-all in the fund. The Compensati­on Fund Process claims submitted by employers to the fund are in relation to injuries sustained by employees whilst on duty, and a disease contracted by employees whilst on duty,” Khula said.

He explained that the mandate of the Compensati­on Fund is derived from Section 27(1) (C) of the Constituti­on of the Republic of South Africa.

“The Compensati­on Fund is a Schedule 3A Public entity of the Department of Employment and Labour. The fund administer­s the Compensati­on for Occupation­al Injuries and Diseases Act No 130/1993 as amended by the Compensati­on for Occupation­al Injuries and Diseases Act No 61/ 1997,” he added.

He said the main objective of the Act is to provide compensati­on for disablemen­t caused by occupation­al injuries or diseases sustained or contracted by employees or for death resulting from injuries or disease, and provide for matters connected therewith.
