Subcontrac­tor plans legal action against dept

A LOCAL subcontrac­tor intends to take legal action against the Northern Cape Department of Roads and Public Works over non-payment for work done at the nurses accommodat­ion site.

The subcontrac­tor once again blocked the entrance of the constructi­on site this week.

He was escorted by the police to the Department of Roads and Public Works after entry to the site was obstructed.

In an affidavit he indicated that he was owed R284,158.33.

“There is still a retention outstandin­g with the relevant people, material on site and works to be measured,” he said.

He added that the new contractor on site had given an undertakin­g on September 5 that he would receive payment by September 19.

“By September 19 no payment was forthcomin­g. The contractor then said that they would pay me during the first or second week of October, on condition that they received payment from the Department of Roads and Public Works.”

The subcontrac­tor stated that some of the other subcontrac­tors had signed new contracts.

“I don’t care if my contract is terminated, I just want the money that is owed to me. If there is still no payment by the stipulated date, I will be taking legal action.”

The Department of Roads and Public Works did not respond to media enquiries.
