Judge kicks out recusal claim

A PRETORIA businessman has failed to have two Supreme Court of Appeal (SCA) judges recused from a case.

SCA Judge Mandisa Maya found on Monday there was no conflict of interest in the case involving Absa. The SCA found Absa was not liable for the conduct of its agent Naresh Mistry who Arif Mahomed and his nephew claimed had swindled them of R7-million.

Maya found they had colluded with Mistry to open accounts in fictitious names. – Ernest Mabuza.
