REGARDING Polo South Africa: a South African entity has signed a trademark licence agreement with Lifestyle Equities CV, the licensor of the “Beverly Hills Polo Club” trademarks.
The name and its trademark, a polo player, was established and first used in 1983. Lifestyle Equities CV has had the rights to the mark in the US since 2008 and has coexisting agreements with Polo Ralph Lauren in several countries. Lifestyle Equities has applied in South Africa for registration of the mark and the application is open for public comment until the end of May.
The LA Group [which owns Polo South Africa] has opposed the application and lodged a complaint with the South African Revenue Service about a shipment of Beverly Hills Polo Club goods to the country. The goods have been seized as counterfeit copies of Polo South Africa’s protected goods. This is a stretch of the imagination. The mark is different to Polo South Africa’s and is easily distinguishable.
Despite having requested both SARS and the LA Group to make available a copy of the complaint and the application for the seizure warrant, it has not been forthcoming. — Aleksandra Borycz, on behalf of Lifestyle Equities
Praise for packer ON April 10 I bought two sixpacks of long-life milk at the Gaterite Supermarket in Verulam. The price on the shelf was R50.99 a pack, but when scanned it cost R55.99. The manager said the shelf price should have been removed some time ago.
But the packer showed that the supermarket’s advertising pamphlet had the lower price. I demanded a refund of R10. Orchids to the packer and onions to the management.— L Govender, Verulam, KwaZulu-Natal
