THE ANC in Limpopo stands to lose its furniture or worse, the provincial headquarte­rs building after the party failed to pay an amount of R183 000 in legal costs.

The legal bill was accrued by the party s provincial youth league in

’ their battle against its provincial deputy secretary Jimmy Machaka, who was fighting his suspension.

Machaka won two cases against the league, one for challengin­g his suspension and another for fighting for his reinstatem­ent to his position.

The ANC lost both cases at the Polokwane High Court and now faces a possible auction of its moveable property and, worse, liquidatio­n as Machaka plans to make an applicatio­n to the court if they fail to pay what s due to him.

’ However, three months after the ruling, the ANC has not settled the bill, despite receiving several letters of demand.

The situation prompted Machaka to go back to court to ask for an order to give the sheriff of the court powers to attach the ANC s property

’ to recover the money.

Sunday World has seen a copy of the execution order authorisin­g the sheriff to grab the governing party s

’ moveable property at the Frans Mohlala House in Polokwane. It is understood the ANC s

’ property at the headquarte­rs includes chairs, computers, two bakkies and a Mercedes-Benz ML 500, which is driven by the provincial secretary.

The writ of execution sent to the sheriff by the court reads: You are

“hereby directed to attach and take into execution the moveable goods of African National Congress Provincial Office, Limpopo Province ... in respect of the taxed costs in the above case.”

Sunday World reported earlier this year Machaka was reinstated by the Provincial Executive Committee (PEC) of the youth league following the two rulings. However, during the same meeting that reinstated him, the PEC also recommende­d his expulsion for taking the ANC to court.

Machaka, who is a qualified lawyer, confirmed he took legal action against the ANC for failing to pay for his legal costs.

He vowed to gun for the liquidatio­n of the ANC youth league in the province if they failed to pay for the legal costs as per the court order. I am tired of court action against “the organisati­on which I love so much. It does no good both to me and the movement, but if I am pushed for further action I will gladly do so in order to protect my right as a person. If needs be I will apply to the high court for its liquidatio­n, he said.

” ANC Limpopo provincial spokeswoma­n Khumbudzo Ntshavheni said it had nothing to do with the mother body; it was a youth league problem.

Limpopo ANC youth league provincial spokesman Matome Moremi confirmed the youth league was served with an execution order by the sheriff two weeks ago. The league does not have “property and therefore that would mean that he would attach property of the mother body. As matters stand, Machaka must “sit down and talk with the ANC instead of him going ahead with the liquidatio­n because if he does, that will be the end of his political career, Moremi said.
