Testimony before Judge Zondo

Testimony heard by Zondo in January 2021 from former spooks boss Loyiso Jafta:

• Huge amounts of cash were carted out of the SSA headquarte­rs in Pretoria, particular­ly in December 2017, in the lead up to the ANC conference.

• R9-billion in fixed assets were not accounted for and R125-million could not be accounted for in the 2017/18 financial year.

• The SSA’S unlawful activities had spilled over into civil society and the trade union movement with the establishm­ent of the Workers Associatio­n Union to rival Amcu in the platinum belt.

• Intelligen­ce funding was subverted to boost the ANC’S performanc­e in elections. For example, in the Western Cape, this involved non-government organisati­ons being given support to shift the political landscape.

Mufumadi report findings:

• Pervasive and serious breaches of financial controls in the SSA involving, in some cases, “serious criminalit­y”.

• Excessive use of cash transactio­ns in the SSA undermines effective financial controls.

• During the 2016 ANC January 8 statement in Rustenburg, the unit on the SSA “initiated three countering operations to impede the distributi­on of CR17 regalia, impede transporta­tion system of dissident groups from GP”.

• There was an almost total breach of financial and other controls by the SO unit resulting in excessive expenditur­e and, in some cases, criminalit­y.

The panel recommende­d that the state urgently institute forensic and other investigat­ions by the competent authoritie­s into the breaches of financial and other controls identified, especially with regard to the PAN project and SO, leading to disciplina­ry and/or criminal prosecutio­ns.
