Charging ex-driver with public indecency ‘tricky’
THE family of the young woman seen in a video of a Mr D food delivery man publically masturbating, plan on opening a criminal case against the driver.
This was confirmed by a Mr D spokesperson yesterday afternoon, who said the family did not wish to speak to the press but said they wanted to lay a charge against the former delivery man.
Police however, have said that no cases have been opened and added opening a case in this matter “would be tricky”.
Two senior police officers said that since the young woman did not see the man masturbating in the video, a case of public indecency would be hard to prove.
The man had come to deliver food, as an employee of Mr D Food delivery, however, once the young woman had received her order and started walking back to the house, the man can be seen undoing his trousers and pleasuring himself in front of the gate in broad daylight.
The incident occurred on Tuesday this week in Pietermaritzburg, however, it is unclear where in the city it happened. It was also confirmed through sources that the man, who delivered the food in his own vehicle, had false number plates.
Mr D has since fired the man and has extended its apologies to the family of the woman involved.
The officers said the woman can open a case with police of public indecency, but warned it would be hard to prosecute as she did not witness the man masturbating.
He added the person who filmed the video might not be able to open a case either, as she is heard laughing at the end of the video and it appears she knew what the man was about to do.
The officer stressed that what the man had done was disturbing and unacceptable.
Mr D Food director Devin Sinclair had said in a statement on Wednesday that as soon as the incident was brought to their attention, the driver was identified and his contract was terminated with immediate effect. • [email protected]ness.co.za
