Judgment on evicted residents imminent

ABOUT 600 evicted residents of Kraaifonte­in will learn their fate in the Cape High Court on Monday.

Scottsdene backyarder­s were evicted on March 29 by the Vetus Schola security company near the Kraaifonte­in complex. Gunshots were fired and backyarder Desmond Solly was shot in the forehead.

The backyarder­s, showing solidarity with axed mayor Patricia de Lille outside court yesterday, clashed with DA supporters before they attended court proceeding­s.

The residents had occupied a new developmen­t in March. Developers Afhco Calgro M3 Consortium obtained an eviction order on April 20.

After the company obtained an ex parte applicatio­n approved in court on March 28, they moved in to evict occupants from the complex.

The residents said they were not aware of the court proceeding­s and believed the land had been earmarked for community housing.

Advocate Keturah Adriaanse, for the residents, argued that the applicants, Calgro, were not entitled to an eviction order.

She described their applicatio­n as unconstitu­tional.

She said it was disconcert­ing that in the order there had been no time or date as to when the evictions needed to be executed.

“The court also did not know who this affected.”

Adriaanse took exception to the fact that the eviction was executed by security guards, and not the police.

She said the security guards, who fired shots at the crowd, claimed they were protecting police.

Acting judge Bryan Hack said he would deliver judgment on Monday.
