A recent judgment found that an employer was entitled to dismiss employees who worked beyond the retirement age indicated in their employment contracts, despite serving them letters regarding salary increases. Werksmans Attorneys say this was the issue considered by the Labour Court in the case of Solidarity on behalf of Gerhardus Viljoen Strydom and five others v State Informatio­n Technology Agency Soc. Ltd. After the employer had allowed the employees to work beyond the retirement age of 60, it enforced the retirement age and served the employees with retirement notices. This was ruled to be fair by the court.
