City to pay yacht club’s legal costs
THE City of uMhlathuze has been ordered to pay punitive costs following the cutting of electricity to the Zululand Yacht Club (ZYC) last month.
The High Court in Durban on Monday issued the order, stating that the rule nisi issued on 12 October was confirmed.
The City of uMhlathuze was interdicted from unlawfully interrupting the electricity supply to the club’s premises, and was also ordered to pay the costs of the application on the attorney and client scale.
Legal action was instituted separately by both ZYC and Richards Bay Ski Boat Club after electricity to both clubs was cut off by the municipality.
At the time the municipality said both clubs’ accounts were 90 days in arrears, hence the power cut.
The matter was taken to court on 12 October and the municipality was given until 26 October to object.
According to ZYC, the City of uMhlathuze did not object by this date.
