City to pay yacht club’s le­gal costs

THE City of uMh­lathuze has been or­dered to pay puni­tive costs fol­low­ing the cut­ting of elec­tric­ity to the Zu­l­u­land Yacht Club (ZYC) last month.

The High Court in Dur­ban on Mon­day is­sued the or­der, stat­ing that the rule nisi is­sued on 12 Oc­to­ber was con­firmed.

The City of uMh­lathuze was in­ter­dicted from un­law­fully in­ter­rupt­ing the elec­tric­ity sup­ply to the club’s premises, and was also or­dered to pay the costs of the ap­pli­ca­tion on the at­tor­ney and client scale.

Le­gal ac­tion was in­sti­tuted sep­a­rately by both ZYC and Richards Bay Ski Boat Club af­ter elec­tric­ity to both clubs was cut off by the mu­nic­i­pal­ity.

At the time the mu­nic­i­pal­ity said both clubs’ ac­counts were 90 days in ar­rears, hence the power cut.

The mat­ter was taken to court on 12 Oc­to­ber and the mu­nic­i­pal­ity was given un­til 26 Oc­to­ber to ob­ject.

Ac­cord­ing to ZYC, the City of uMh­lathuze did not ob­ject by this date.
