Mahinda Madihahewa

Skillfully handled conflicts in industrial relations can be beneficial and could lead to solution of troublesome problems and a poorly handled conflict can be dangerous and damaging; relationship may suffer and productivity may decline, Mahinda Madihahewa, Secretary, Ministry of Senior Minister’s Secretariat said.

Speaking at the Launch of “Kamkaru Neethiyata Athwelak”, the Sinhala Translation of “Practical Guide to Labour Law” by S. Vimalarajah, he further said that conflict in industrial relations was generally considered to be normal. It had been said that conflicts, tensions, and disputes were at the very heart of industrial relations.

But, he added that at the end of the day what was essential was the understanding, preventing and finding solutions. “One may ask whether conflict was bad, Not necessarily. If handled right it could be a good thing. It could function as a safety valve, letting people vent frustration. But unmanaged conflict can be costly and harmful, both economically and psychologically for individuals and organizations.”

In his book Mr. Vimalarajah has devoted a chapter on ‘Domestics and Employees Provident Fund’. What he had tried to achieve was to address certain contradictions on whether domestic workers were entitled for EPF.

The domestic sector was an area where we have very little information, Mr. Madihahewa said.

He added that considering the significance of this occupation the ILO in the 99 Session of the International Labour Conference held in June 2010, adopted international labour standards in the form of a Convention and an accompanying recommendation. Domestic work was a growing occupation for Sri Lankans both locally as well as abroad; hence it was necessary to encourage more discussions on a wide range of issues relating to domestic workers.

Mr. Vimalarajah has always been a leader in his profession. He is not only competent in dispute resolution, but also in protecting and furthering the rights and welfare of fellow officers.

Judges of the Supreme Court, Justice Saleem Marsoof, Justice Suresh Chandra, Secretary to the Ministry of Labour and Labour Relations, Upali Wijayaweera also participated at the event.
