Motion in SC to release body of prisoner

A motion in the form of an agreement for the release and burial of the body of Tamil prisoner Ganeshan Nimalaruba­n was filed in the Supreme Court.

The motion signed by both Deputy Solicitor General Shavindra Fernando for the Attorney General and Counsel Saliya Peiris for the parents of the deceased filed the motion in the face of abrupt disruption of the normal functionin­g of the courts all over the country.

Work in all courts throughout the country came to a grinding halt as a result of a boycott of courts by judges and lawyers as a mark of protest against the alleged attack on the Mannar courts.

In the motion, the parents of the deceased Petitioner Nimalaruba­n have agreed with the Attorney General with regard to the release and burial of the body of their son as follows:

The Attorney General will give appropriat­e directions to the police to agree in MC (Mahara) to release the body of the deceased to the parents for burial in Vavuniya;

The parents of the deceased will coordinate with SSP Vavuniya on the modalities of transporti­ng the body of the deceased to Vavuniya and the funeral arrangemen­ts in Vavuniya;

The parents of the deceased will coordinate with SSP Vavuniya on the modalities of transporti­ng the body of the deceased to Vavuniya and the funeral arrangemen­ts in Vavuniya

Accordingl­y the police will be directed to take appropriat­e steps, subject to and order by the Magistrate to have the body of the deceased handed over to the parents on July 23.

Accordingl­y parties seek that the Registrar be directed to communicat­e to the Magistrate of Mahara, the contents of the motion.

When the applicatio­n by the parents of Tamil prisoner Nimalaruba­n of Nelukulam, Vavuniya for his body be taken to Vavuniya for burial came up before the Supreme Court on Wednesday (18), the Attorney General sought an undertakin­g that the funeral should be conducted in low profile without causing problems to national security.

Saliya Peiris with Eugene Mariampill­ai and Ms A. Shelrine looked after the interests of the deceased Nimalaruba­n.
