The bodyguard Anura Thushara De Mel is the first suspect i n t he case which was t aken up for hearing by Additional Magistrate Priyantha Liyanage.
Court Mudliyar Indika who read out the names found that De Mel was not present in court. His Counsel Anuja Premaratne informed the Magistrate that he was unaware of his client’s nonappearance in Court.
The third suspect’s Counsel Ravindra Silva informed court that his client Chaminda Ravi Jayanth was unwell and that his mother who had stood surety was in court. He said the medical certificate would be filed in court on the next date.
State Counsel Thusith Mudalige told the Magistrate that two of the suspects were not present in Court and on the next date Duminda Silva would not be available because he was going abroad for treatment. He said this would lead to the case being postponed unnecessarily.
Counsel Anuja Premaratne said he would file his submission by way of a motion to ascertain whether the nonsummary inquiry was being held under section 53 or 54 of the Criminal Procedure Code. The Magistrate postponed the case for February 6.
The suspects are: Chandana Jagath Kumara, Chaminda Ravi Jayanath, Lanka Rasanjana, Malaka Sameera, Vidanagamage Amila, Sarath Bandara, Suranga Premalal, Saman Kumara Abeysinghe, Duminda Silva, Rohana Marasinghe and Nagoda Liyanarachchige Chaminda were charged for inflicting gunshot injuries while being members of an unlawful assembly and committing the murder of Bharatha Lakshman Premachandra, Damitha Dharshana Jayathilaka, Jailabdeen Mohamed Azmy, and Manimel Kumaraswamy for infliclicting gunshot injuries to Mr Premachandra’s bodyguard Rajapurage Gamini at Walpola Junction in 2011 on the day of the local government election for KotikawatteMulleriyawa Pradeshiya Sabha.
