Arbitrary violation of FR?
The responsibility of the Public Service Commission is to protect the public servants from unnecessary political interference especially when they carry out their duties according to the rules and regulations of the establishment code. Before the 1972 constitution, we had a powerful Independent Public Service Commission. But after the cabinet of ministers took its powers into their hand public servants were forced to dance according to the tunes of the ruling party politicians. Today, we see some public servants who had held a high post in the state sector under the previous regime now are facing court proceedings due to various charges levelled against them.
Under the present yahapalanaya government also too we see the present IGP is more critical among the joint opposition politicians. During the last few weeks, he was the main target in private TV channels. However, it is the politicians who want to expel him not the general public. Many argue that his personal behaviour is not suited for such a high post he holds in the police department. If his performance is not good it should be applied to the other heads of the state sector too like in the Governor of the Central Bank etc.
If there is any complaint against him, it is the duty of the Police Commission as well as the Public Service Commission to investigate it without asking to ask him to resign before any inquiry being made because he is a public servant and not a politician. NO one could be allowed to dismiss or resign either the government or private sector according to his or her personal behaviour because it is a violation of the fundamental right of a person according to my view.
