A 30-year-old male of Mankayane area has been charged with the rape of his five-yearold bi­o­log­i­cal daugh­ter.

Phi­lani Tfwala stood be­fore mag­is­trate Si­fiso Vi­lakati to an­swer for con­tra­ven­ing sec­tion 3 (1) (2) (3) as read with sec­tion (9) (a) of the sex­ual of­fences and do­mes­tic vi­o­lence Act15 of 2018. When the sus­pect was in­formed about his rights to le­gal rep­re­sen­ta­tion he re­sponded by stat­ing be­fore the hon­ourable court that he would be seek­ing le­gal rep­re­sen­ta­tion. Crown rep­re­sen­te­tive Chris Sibandze ap­plied that the ac­cused per­son be re­manded into po­lice cus­tody util the 16 of Novem­ber pend­ing re­set­ting of trial date be­fore the Prin­ci­pal mag­is­trate.

Si­fiso Vi­lakati put it to the ac­cused that he has been charged with a se­ri­ous of­fence and there­fore ad­vised him to move a bail ap­pli­ca­tion at the High Court.

The dispi­ca­ble in­ci­dent is said to have oc­cured dur­ing the month of Oc­to­ber at Mah­walala. Take fur­ther note that the of­fence is ac­com­pa­nied by ag­gra­vat­ing fac­tors as en­vis­aged by sec­tion 185 B of the crim­i­nal pro­cee­dure and ev­i­dence Act 67 of 1938 in that the ac­cused is a father of the com­plainant and that she is only five years old. He was re­manded into cus­tody as per the crown’s ap­pli­ca­tion.
