Obama bail application removed from roll
THE bail application that was filed by murder suspect Lucky ‘Obama’ Matsenjwa at the High court has been removed from the roll.
This is after an indication by Matsenjwa’s defence team which stated that they have since considered the move to file a review application at the Supreme Court.
Advocate Lucas Maziya after having taken instructions, informed the court that they are still in the process of eventually moving the application at
the Supreme Court.
Meanwhile, Crown Counsel Ncamsile Masuku submitted that the main issue in Matsenjwa’s bail application is that of interference with witnesses and the alleged elimination of a witness in Mduduzi ‘Schaza’ Matsebula. The Crown conceded that the applicant (Matsenjwa) should approach the Supreme Court for review of its judgment.
Advocate Maziya on Wednesday had submitted that what the crown did in as far as the applicant interfering with crown witnesses and the allegations of eliminating witnesses, was just a blanket statement and that the court could not be bound by what the earlier court heard.
Maziya had stated that the witnesses have testified and the whole status has changed as the question of interference falls away since more than 16 witnesses have already given evidence with only three witnesses left, being the South African Police Service (SAPS) officers.
