Obama bail ap­pli­ca­tion re­moved from roll

THE bail ap­pli­ca­tion that was filed by mur­der sus­pect Lucky ‘Obama’ Mat­sen­jwa at the High court has been re­moved from the roll.

This is after an in­di­ca­tion by Mat­sen­jwa’s de­fence team which stated that they have since con­sid­ered the move to file a re­view ap­pli­ca­tion at the Supreme Court.

Ad­vo­cate Lu­cas Maziya after hav­ing taken in­struc­tions, in­formed the court that they are still in the process of even­tu­ally mov­ing the ap­pli­ca­tion at

the Supreme Court.


Mean­while, Crown Coun­sel Ncam­sile Ma­suku sub­mit­ted that the main is­sue in Mat­sen­jwa’s bail ap­pli­ca­tion is that of in­ter­fer­ence with wit­nesses and the al­leged elim­i­na­tion of a wit­ness in Mduduzi ‘Sc­haza’ Mat­se­bula. The Crown con­ceded that the ap­pli­cant (Mat­sen­jwa) should ap­proach the Supreme Court for re­view of its judg­ment.

Ad­vo­cate Maziya on Wed­nes­day had sub­mit­ted that what the crown did in as far as the ap­pli­cant in­ter­fer­ing with crown wit­nesses and the al­le­ga­tions of elim­i­nat­ing wit­nesses, was just a blan­ket state­ment and that the court could not be bound by what the ear­lier court heard.

Maziya had stated that the wit­nesses have tes­ti­fied and the whole sta­tus has changed as the ques­tion of in­ter­fer­ence falls away since more than 16 wit­nesses have al­ready given ev­i­dence with only three wit­nesses left, be­ing the South African Po­lice Ser­vice (SAPS) of­fi­cers.
