AAP donations come under scrutiny

SHOW CAUSE NOTICE SENT TO DELHI RULING PARTY FOLLOWING AN ALERT BY THE CENTRAL BOARD OF DIRECT TAXES

The Election Commission of India yesterday asked the ruling party in Delhi to explain donation discrepanc­ies in its 2014-15 financial report.

The show cause notice was sent to the Aam Aadmi Party (AAP) following an alert by the Central Board of Direct Taxes (CBDT), with the ruling party calling the allegation­s “grossly incorrect and biased observatio­ns” by the poll panel.

The CBDT had written to the poll panel in January, saying the donations filed by AAP with the income tax department and the commission did not match.

The AAP, according to the poll panel, submitted its 201415 “original Contributi­on Report” on September 30, 2015 and later a revised report on March 20, 2017. The first report contained a list of 2,696 donors with the total donations amounting to Rs374 million (Dh18.8 million) and the revised report showed the amount as Rs376 million received from 8,264 donors.

“A report has been received from the office of the chairman, CBDT, in January 2018 regarding the concealmen­t of donations received by the AAP during Financial Year 2014-15,” said the Election Commission notice.

‘Unknown sources’

The notice, citing the CBDT report, alleged the AAP bank account had recorded Rs676.7 million worth of credits.

“However, the party has disclosed total income of Rs541.5 million from donations in its audited accounts. Therefore, it has been held that Rs131.6 million has not been accounted for by the party and these donations have been held to be from unknown sources.”

The CBDT report stated that the party had taken Rs20 million from hawala operators which “have also been wrongly disclosed as voluntary donations”.

It alleged that the party had made wrong disclosure­s on its website and also furnished incorrect informatio­n.

The report detailed how the party had changed or revised its Contributi­on Report once the accuracy of the same was questioned.

“In conclusion, its disclosure­s to the Election Commission are incorrect and ... there are several discrepanc­ies in the Contributi­on Report.”

The commission has directed the AAP to show cause as to why action should not be taken against it for failure to follow the EC’s directions.

“Your representa­tion should reach the office of the commission within 20 days (by October 1) from the date of receipt of the notice, failing which the matter will be decided on merits based on informatio­n available on record.”

‘Misinterpr­etation’

The AAP in a statement said the poll panel notice was based on “poor interpreta­tion of basic accounting practices by the CBDT”. It said the party’s 201415 report had details of multiple receipts from same donor which had not been understood properly.

“Even the amount of donations in Original Contributi­on Report is wrongly mentioned in the notice. Election Commission has copy-pasted and referred grossly incorrect and biased observatio­ns of Income Tax Department in its notice.

“Even bank transfers between different state units of the Aam Aadmi Party have been treated as fresh donations. Such observatio­ns show deep rooted bias of (the) statutory authority (CBDT) against a law abiding political party.”

The AAP statement said it has explained each and every “misinterpr­etation” and so called “difference of Rs130 million” as alleged by the CBDT in its appeal which is pending.

“We will explain each and every detail to the Election Commission. We firmly believe that we can be harassed by agencies but ultimately truth will triumph.”
