Insurance company ordered to pay Dh311k for car damaged in accident

abu dhabi — A motorist, whose vehicle was written off the road after being involved in a horrific crash, has been awarded Dh311,000 in compensati­on for the damages.

The Abu Dhabi Court of First Instance ordered the insurance company to pay the man Dh311,000, which is equivalent to the market value of the vehicle.

The court documents stated that the Arab driver lost control of the vehicle, which veered off the road and flipped in the air.

The man sustained minor injuries but the vehicle was completely damaged.

The police had to write the vehicle off the road after the engineers’

report said it posed threat to the occupants and other road users and was no longer fit to be on the roads.

The motorist then filed a lawsuit against the company that insured his vehicle and demanded compensati­on.

He had filed an expert report showing that he had a comprehens­ive insurance policy which covered both his life and the car and he is eligible to compensati­on in the event of an accident.

The expert’s report also said that the car was badly damaged, including damage to the chassis, rendering it unfit to be on the roads.

The insurance company had submitted a memorandum requesting that the claim be dismissed because it was not responsibl­e for the damages. “The motorist was responsibl­e for causing the accident as he was reckless and was driving under the influence of alcohol,” it claimed.

The court, however, dismissed the claims for lack of evidence and ordered the insurance company to pay him Dh311,000, which is the market value of a new car.

The court said in its ruling that the insurance company was responsibl­e to foot all expenses or pay for the value of a car covered by a comprehens­ive insurance policy and has been written off the road.

The motorist was responsibl­e for causing the accident as he was reckless and was driving under the influence of alcohol.”
