Assault ‘ victim’ spent night in police cells

-

A man who called police during a domestic disturbance ended up with a night in the cells.

James Dolan, 33, of Shawlands Street, Catrine, appeared at Ayr Sheriff Court last week.

He pleaded guilty to behaving in a threatening or abusive manner by shouting, attempting to prevent his partner from leaving, making threats and struggling with police in Mill Street, Catrine, on June 16.

Fiscal depute Scott Toal said: “Police were called after 1am when the accused reported he had been assaulted.

“They investigated the matter but he was quite argumentative and he was advised to go to bed.”

He called them againat 3am. Mr Toal said: “Police spoke to the partner, who stated she wanted to leave and go to her parents’ address.

“The accused was spoken to and became more aggressive. He did not want her to leave.

“He was told to calm down and on being advised she was leaving he became abusive.”

He added: “It’s his position that he was assaulted by her friends and became increasingly aggressive.

“Out of concern for him officers felt they had no option but to arrest him. He was not charged due to his aggressive behaviour.”

Dolan’s solicitor Glenn Davis said: “He has no previous convictions and he’s building bridges with his partner and she is supportive.

“There’s some learning issues for him.” Sheriff Desmond Leslie told Dolan: “This can’t continue. You have to address these issues.”

Dolan was placed under supervision for 18 months.
