Bath Rugby just wasting its time

Bath Rugby’s success at the Supreme Court in overturnin­g the 1922 restrictiv­e Covenant on the Rec must have cost the Company an arm and a leg.

It is seriously misguided. In 1956 the Rec was sold to the Citizens of Bath conditiona­l on it remaining open space in perpetuity amongst other conditions, an Agreement signed by the Council as legal Custodian.

Attempted withdrawal of this condition would fly in the face of property law since 1846 and would require only one Citizen to bring a private prosecutio­n to overturn such an attempt.

The title is held by Bath Recreation Ltd on behalf of the Citizens of Bath and that Company is bound by the 1956 conditions.

Its job is to maintain the Rec on behalf of Citizens.

Bath Rugby has wasted 25 years chasing a myth and would be better advised to build a state of the art stadium on its own property. Steve Osgood Bath
