Siblings ‘killed own brother’ in family feud

TWO brothers have gone on trial accused of stabbing their younger sibling to death.

Thomas Rogers, 26, was found critically injured in Bristol Road, Bournbrook on August 22 last year.

Samuel Rogers, 30, of Suttonin-Ashfield, Nottingham­shire, and David Rogers, 32, of South Shields, have denied a charge of murder.

Two other men, Ryan Hurt, 22, of Mansfield and Macauley

Welby, 22, of no fixed address, have pleaded not guilty to the same charge.

Michael Burrows QC, prosecutin­g, told the jury: “On the afternoon of August 22, Thomas Rogers was deliberate­ly stabbed in the chest with a knife. The man who stabbed him was David Rogers.

“The three other defendants were with David Rogers. Samuel Rogers and Welby were also armed with weapons. They joined in the attack. They are also guilty of murder. Samuel Rogers accepts he was armed with a knife.”

Mr Burrows said: “There is a background to this case, a family feud. Thomas Rogers had fallen out with his family. In March 2020 Thomas went to live with his mother.

“In June last year David Rogers was arrested for a drugs offence. Tom and David fell out. Tom said several times he was going to knock David out. On July 3 Tom left her home.”

He said he then came to live in Birmingham.

“On July 19 Carol Rogers (the mother) reported Tom to the police. She wanted to stop him sending messages. Carol Rogers received a text threatenin­g her. She sent it on to David and Samuel.”

Mr Burrows added: “Samuel Rogers lived in Mansfield and someone smashed windows in his home. David got to hear about that incident.”

He said Ryan Hurt drove the defendants to Bristol Road, Birmingham where they pulled up in front of an Astra in which Tom was sitting.

He alleged: “David Rogers was holding a knife in his right hand. You can see David Rogers leaning towards the open window. Welby was holding a large hammer. Samuel Rogers was the third man.

“It appears he was recording events. The whole attack lasted 30 seconds.”
