Can I demolish and rebuild a retaining wall without planning permission?
I have a sloping plot with an old stone retaining wall. I am awaiting planning permission for a single dwelling. I want to know if it would be possible to demolish, rebuild and extend the wall before consent is granted? It sits within my land and about 15m from any boundary.
If the wall is less than 2m tall, then it should enjoy permitted development rights to rebuild or extend. However, because it is a retaining wall, the council might consider that the works would represent an engineering operation. As such, they wouldn’t be permitted development and a planning application would be required. It would probably have made sense to include any potential changes to the wall within the planning application for the new home, but if it’s too late to do that, discussing the works with the application case officer should reveal whether or not the council thinks permission is going to be needed.
