Woman driver refused to take breath test

A woman who crashed her car while driving home from a pub, before going home and to bed, has had her sentence deferred.

Emily Sheila Kerr, 21, of Gamekeeper­s Cottage, Hutcheon Road, Campbeltow­n, pleaded guilty to failing to provide two specimens of breath for analysis which were required to ascertain her ability to drive or the proportion of alcohol in her breath when she was driving a car in Burnbank Street, Hutcheon Road and other roads in Campbeltow­n on April 25 this year.

Procurator fiscal depute Eoin McGinty told the court that police received a report of a crashed vehicle and, after identifyin­g Kerr, who has no previous conviction­s, on CCTV, traced her at home.

Kerr, who smelled of alcohol, admitted being the driver. She was taken to Campbeltow­n Police Station but refused to take a breath test.

Sheriff Patrick Hughes deferred sentence until July 25 for a criminal justice social work report and a restrictio­n of liberty order assessment to be carried out and disqualifi­ed Kerr from driving for the time being.
