Topless man threatened to slash and kill cops
A TOPLESS man ended up threatening to kill police and spitting at them, a court has heard.
Kieran McFall, 20, appeared for sentencing at Dumbarton Sheriff Court after admitting his aggressive outbursts committed more than a year earlier.
Police arrived at Peel View, Clydebank, just after midnight on September 3, 2022 and found McFall in a common close with his top off, the court was told.
“He immediately became aggressive with officers,” said the fiscal depute.
McFall was arrested initially as a non-officially accused person and taken to Clydebank police office. But in the course of the journey and at the station, he continued to hurl abuse at officers.
His threats included “you’re dead” and vows to “slash them”.
He continued to be abusive to officers and then aimed a “glob” of spit at one of them, narrowly missing.
McFall, previously of Peel View and now of the town’s Dunswin Court, pleaded guilty before a trial to acting in aggressive manner, shouting, swearing and repeatedly uttering threats of violence and threatening to kill officers, repeatedly uttering offensive and homophobic remarks and repeatedly striking his head and feet on the police cell van. He also repeatedly spat on the van.
The offence was aggravated by prejudice relating to disability and to sexual orientation.
He also admitted culpably and recklessly denying he had any sharp instruments ahead of a search before a blade was found in his pocket.
And he admitted assaulting a cop by spitting at him.
McFall’s defence solicitor said his client was on a community payback order (CPO) imposed earlier this year at the Justice of the Peace court.
He said: “What your ladyship hears is how he was when 19.
“He has commented about how disgusted he was that he behaved in this particular way.
“This is by far the most serious matter he has got. He is not quite as angry a man as he was in September 2022. He seems to have got himself back on track.”
Sheriff Lindsey Kooner said: “There’s a significant change from the man who engaged in this conduct in September 2022.
“These matters occurred in September 2022 and the [social work] report indicates all of the matters you have come before the court for were during a seven-month period, triggered by matters in your personal life.
“I’m persuaded by your circumstances and age not to send you to custody.”
She imposed a new CPO with supervision by social workers for 15 months. His progress will be reviewed in three months and unpaid work in the community will be considered as a punishment later.
