Cowboy builder faces being jailed
TRADING STANDARDS TAKE MAN TO COURT AFTER IT RECEIVED NUMEROUS COMPLAINTS FROM CUSTOMERS
A BUILDER faces being jailed if he breaks a court order after customers complained about his business.
Mark Anthony Kellegher from North Warwickshire has been warned he could be put in prison if he doesn’t trade fairly.
Warwickshire Trading Standards received a number of complaints about Kellegher’s business M A K Building Services Limited.
Kellegher of Allens Close, Baddesley Ensor, near Atherstone, was given an Enforcement Order by Coventry County Court to trade fairly or face a possible jail sentence for contempt of court.
Warwickshire County Council Trading Standards took it to court after receiving a number of consumer complaints about the business.
James Greenaway, Warwickshire Trading Standards Team leader said: “Home improvements can amount to thousands of pounds and the effects of having this type of work done badly can be devastating financially and emotionally to customers.
“Trading Standards will continue to monitor this business to ensure that it is complying with the law and will not hesitate to take action if they breach the Enforcement Order.”
The enforcement order forbids Mark Anthony Kellegher and his business MA K Building Services Limited from:
Making false or misleading statements to consumers about delivery dates for goods and services.
Failing to pay suppliers and con- tractors etc, resulting in customers having to pay themselves.
Failing to remove waste from customer’s properties. Failing to complete work, or Demanding extra payment for a piece of work beyond that quoted.
Kellegher must also now ensure that the work he does is performed with reasonable care and skill, within a reasonable time and at a reasonable price (and no more than that price).
A breach of the order is contempt of court. If this happens it may lead to a fine, imprisonment or company assets being seized. The team can give advice on how to resolve the problem and Trading Standards will use the information to enable them to investigate breaches of the law and better target traders with the highest number of complaints.
