S. G., Shep­per­ton, Middx. I’M afraid not. In ef­fect, all your hus­band’s IHT al­lowance was used when it was put into trust, so even though you have ac­cess to the trust, you can’t use his al­lowance again when you die, ac­cord­ing to Sus­sex-based es­tate plan­ner Spof­forths.

This was the cor­rect le­gal ad­vice at the time, but the rules have now been re­laxed to al­low hus­bands and wives t o have ac­cess t o any un­used por­tion on t he sec­ond death with­out need­ing to set up a trust.
