SECTION 4 of the 2 th Amendment of the US Constituti­on provides a mechanism for the President’s cabinet to instantly unseat him.

They can do this, with the Vice Presiden, if they feel Mr Trump is ‘unable to discharge the powers and duties of his office’.

All it needs is for his deputy and a majority of the core government – in this case at least eight of the 1 cabinet secretarie­s – to write a letter to Congress saying the President is unfit to govern.

Once the letter is received, the Vice President – Mike Pence – immediatel­y becomes Acting President.

If the President objects to this act, then his government opponents have four days to raise a counter-objection. Then if that happens, Congress has 21 days to ultimately decide whether to reinstate the President.

Which means that if Mike Pence were to do this today, then he would automatica­lly be in office for the remaining 12 days of Mr Trump’s presidency.

The Amendment was signed into law in 1967, after the assassinat­ion of John F Kennedy four years earlier sparked questions about Presidenti­al succession.

The law – which has never been used – is meant for a President physically incapable of governing, but in Mr Trump’s case it would be down to his mental health.
