Ed is accused of copying Marvin
ED Sheeran must face trial in the US over claims he copied Marvin Gaye’s 1973 classic Let’s Get It On in his 2014 hit Thinking Out Loud.
In Manhatten on Thursday, US District Judge Louis Stanton denied Sheeran’s bid to dismiss the copyright infringement suit, saying a jury should decide on whether the two songs are substantially similar.
It comes after Sheeran, 31, pictured, and his co-writers were handed more than £900,000 in legal costs in June after winning a UK High Court copyright trial over his 2017 hit Shape of You. The court found Sheeran ‘neither deliberately nor subconsciously’ copied a 2015 song, Oh Why, by Sami Switch and Ross O’Donoghue.
The US £90million suit was originally lodged in 2018 – not by Gaye’s family, but by Structured Asset Sales LLC, which owns a portion of Let’s Get It On co-writer Ed Townsend’s estate.
