COLLECT EVIDENCE
NOTE the pothole’s location, time and date you hit it, and take a photo if safe. Get a garage mechanic’s report of the damage in writing.
FIND WHO’S RESPONSIBLE
RESPONSIBILITY for maintaining local roads lies with local councils in England, Wales and Scotland. National Highways and regional equivalents deal with strategic roads. To help prove negligence, ask for copies of highway maintenance schedules and reports of incidents (within 14 days of an accident). Seek evidence showing that had the council acted, the incident wouldn’t have happened.
REPORT IT
FILE a formal claim with evidence — including a mechanic’s report, repair costs (with invoices and receipts) and photos.
TAKE ACTION
IF A council’s compensation offer fails to cover your costs, demand more. If your claim is rejected (unfairly) consider legal advice, though it could be costly if your case goes to court. Source: Admiral insurance
