COLLECT EVIDENCE

NOTE the pothole’s location, time and date you hit it, and take a photo if safe. Get a garage mechanic’s report of the damage in writing.

FIND WHO’S RESPONSIBL­E

RESPONSIBI­LITY for maintainin­g local roads lies with local councils in England, Wales and Scotland. National Highways and regional equivalent­s deal with strategic roads. To help prove negligence, ask for copies of highway maintenanc­e schedules and reports of incidents (within 14 days of an accident). Seek evidence showing that had the council acted, the incident wouldn’t have happened.

REPORT IT

FILE a formal claim with evidence — including a mechanic’s report, repair costs (with invoices and receipts) and photos.

TAKE ACTION
