Appeal had ‘no real prospect of success’

A JUDGE has ruled a newspaper must go to the Court of Appeal to challenge a bruising defeat in a privacy case against the Duchess of Sussex.

Sunday and Mailonline was sued by the Duchess of Sussex over five articles published in February 2019 which revealed extracts of a letter she sent to her father, Thomas Markle, 76.

Associated Newspapers’ lawyers applied for permission to appeal that ruling.

But the judge refused saying it had “no real prospect” of success and ruled the publisher must show how much it gained financiall­y from publishing the letter.

A spokeswoma­n for The Mail On Sunday said: “We will be applying to the Court of Appeal for permission to appeal his decisions on both claims.”

A CAT missing for five days was rescued after it fell down a chimney pot.

Fluffy had been scared off a roof by a local who tried to help him and was left stuck in a wall cavity.
