Aldi Cuthbert cake ‘free’ as claim settled
ALDI’S Cuthbert the Caterpillar is now “free” after the firm settled a cake copyright row with M&S.
Marks & Spencer had accused the German discounter of copying its Colin the Caterpillar cake.
Both firms confirmed an agreement has been filed at the High Curt last week but said they could not release details of the “confidential” deal.
M&S first launched the lawsuit against Aldi in April last year.
In May, Aldi started selling its cake again after making changes to its chocolate face design.
A spokesman for Aldi said: “Cuthbert is free and looking forward to seeing all his fans again soon.”
An M&S spokesman said: “We are very pleased with the outcome.”
