SMITH DOCUMENTS DON’T EXIST, COURT TOLD

EX-RANGERS boss Walter Smith was ordered to surrender documents relating to a £320,000 court action – which it emerged don’t exist.

The 70-year-old Ibrox legend is suing his former financial advisers Neil Caisley and Gareth Alexander over cash invested when he was BY ALAN McEWEN managing Premier League Everton.

Lawyers for Alexander previously sought a court order forcing Smith to hand over documents they said could help the defence.

At the Court of Session in Edinburgh yesterday, judge Lord Bannatyne agreed to grant the demand. Advocate Neil Beynon, acting for Smith, then said: “There aren’t any documents”.

Lord Bannatyne told David Thomson QC, acting for Alexander: “You were well-warned that this was the position.”

Smith claims Caisley, of Codicote, and Alexander, of Harpenden, both Hertfordsh­ire, agreed to return £600,000 to him. But the former Scotland manager says they only paid £280,000.

It’s understood Smith is suing the pair over a pension fund set up while he was Everton boss in the 90s.

Caisley, 60, is no longer contesting the legal bid but Alexander, 45, is still fighting it.
