Man threatened ex after being told to stay away
A man threatened his former partner two days after a court ordered him to stay away from her.
Daniel Hussain, 30, has now been warned to expect longer jail sentences if he keeps behaving in this manner.
Hussain admitted contacting the woman via social media and phone calls and threatening her in
March last year.
The messages started after he was given a two-year nonharassment order over a disturbance at her home in Forbes Place, East Kilbride.
He had also breached an earlier nonharassment order imposed in November 2020 by having contact with the woman.
John Coogan, prosecuting, told the latest hearing at Hamilton Sheriff
Court that the couple had split after a six-year relationship.
Hussain was freed from court with a community payback order in March last year, but almost immediately started phoning the woman and sending her Facebook messages.
He was demanding to see their child.
Mr Coogan said that the woman ignored most of the calls but when she answered one of them Hussain told her:“If I can’t get to see my wean I’ll be at your door.
“You’re getting it.” Eventually she contacted the police and Hussain, who had moved to England, was arrested in Coventry.
He protested to police officers:“I’m getting jailed for no reason.”
Defence agent David Kinloch described the couple’s relationship as “tempestuous”.
He claimed that the initial contact in March last year had been made by the woman, but Hussain should have known that it was“simply not allowed”for him to follow this up.
SheriffThomas
Millar jailed Hussain for 18 months, but backdated that to
August last year as he had been in custody since then.
That meant, under early release roles, he was likely to be freed immediately.
However, the sheriff warned him:“Any repeat of this behaviour and the sentence will likely go up.”
Hussain was also handed a fresh two-year nonharassment order.
