Crash man seeking £5k in damages

A Broughty Ferry man is seeking more than £5,000 in damages after claims he suffered lasting injuries in a crash on a busy Dundee road.

David Robb, of Stracathro Terrace, hurt his shoulder after the smash on Greendykes Road.

Mr Robb, who was 24 at the time of the accident on September 15 2011, has raised an action at the Court of Session in Edinburgh.

He is now 27 and is understood to be claiming that he still has physical consequenc­es as a result of the accident.

The man he is taking to court is Scott Francis Barron, of Camphill Road, Broughty Ferry.

It is understood Mr Barron was driving the vehicle on the northbound side of Greendykes Road at the time of the crash and Mr Robb was a passenger.

Progress in the case is still at an early stage and the action has been raised now in order to meet the Court of Session’s strict deadlines.

In Scots law, the time limits within which a court action must be raised are determined by the Prescripti­on and Limitation (Scotland) Act 1973.

The limitation period is three years from gaining knowledge of the original injury.

A spokesman for the Dundee office of Digby Brown solicitors confirmed its lawyers are handling Mr Robb’s case.

He said: “We can confirm we have raised an action in the Court of Session on the pursuer’s behalf. As the case is ongoing, we cannot comment further.”

The Tele was unable to reach Mr Barron by the time of going to press.

Road is a hotspot for crashes. Police Scotland figures showed that in the last 12 months of available data, there were eight separate collisions on the dual carriagewa­y.

Six of those crashes did not cause any injuries, but two were marked as being incidents where either an injury or fatality was sustained.

In total, there were nearly 200 serious road crashes in Dundee over the last year that led to injuries and death.
