Man who assaulted kid, 12, sentenced

Oktawiusz Burblis bent his victim’s thumb back and twisted his arm in what was described by a sheriff as a “horrendous” assault.

Burblis, 29, of Chalkhill Court, previously admitted that on November 1, in Kirk Street, Lochee, he assaulted the boy.

The Polish national threatened to slit the boy’s throat and seized him by the body.

Burblis further admitted that on the same date, in Adamson Court, Kirk Street, he possessed cocaine, a Class A drug.

At a previous court hearing — where Burblis pleaded guilty to the offences through an interprete­r — Sheriff Derek Reekie said that the assault charge was of “considerab­le concern” to him.

Sheriff Reekie added: “It involved a 12-year-old child who was on the receiving end of horrendous behaviour by you.”

Fiscal depute Trina Sinclair told Dundee Sheriff Court that Burblis ran his finger across the boy’s throat, before grabbing the youngster and bending his thumb back.

Ms Sinclair said the cocaine recovered was valued at £100.

Solicitor Anika Jethwa, defending Burblis, told the court: “This is a serious crime, but he is not subject to any court orders. He is not on bail and while he has some previous conviction­s, none of them are of an analogous nature. He was very drunk and has very little recollecti­on.

“The boy was not known to him and he is very remorseful and very sorry for his actions — he can’t remember behaving in this manner.

“It has finally dawned on him that he needs help to address his behaviour. He is Polish, but has been living in Dundee since 2011 and he tells me he wants to get help for these issues.”

The lawyer previously recommende­d Burblis be given a community-based disposal.

His sentence was initially deferred for or a criminal justice social work report and a restrictio­n of liberty assessment to be carried out.
