No jail time after assaulting partners

A transgende­r man has admitted domestic abuse against two females.

At the time Charlie Daniel was still a woman and was known as Lisa Nelson.

Daniel, 32, avoided a prison sentence at Hamilton Sheriff Court, pictured, this week, but was warned that he must disclose the identity of any new partner to social workers at the start of the relationsh­ip.

He admitted conduct that caused two women fear or alarm.

Daniel was living with the first woman in Edinburgh during a two-and-a- half-year relationsh­ip that ended in November 2017.

The relationsh­ip with the second woman lasted 18 months and included violence at their home in Auchinrait­h Terrace, Blantyre.

Daniel also admitted assaulting the second partner who required hospital treatment for facial injuries in November 2019.

The court heard that Daniel, who has a previous conviction for domestic abuse, now lives in Peterhead.

His lawyer put his behaviour down to drugs misuse, saying he had been taking cocaine, Valium, ecstasy and even cough mixture.

The lawyer stated: “My client is a transgende­r male who began the transition in July 2021.

“He has been receiving testostero­ne injections regularly and is very much afraid that a custodial sentence would make such treatment problemati­c.

“He has had mental health issues and, although there has been progress recently, custody would likely have a further negative impact on him.

“He’s been drug-free for three years.” The lawyer described Daniel’s relationsh­ip with the second victim as “toxic”.

Passing sentence, Sheriff Martin Jones told Daniel: “While I’m satisfied these offences cross the custody threshold, I’ve had regard to background reports and what’s been said in mitigation, and I’m prepared to impose a community payback order.”

The sheriff placed Daniel under supervisio­n for two years and ordered him to attend “domestic abusefocus­ed work” as directed and to tell his supervisor the name, date of birth and address of any new partner.

Daniel must also carry out 100 hours of unpaid work and will be electronic­ally tagged for eight months, meaning he’s confined to home between 7pm and 7am each day.

The sheriff warned: “If you breach any of these orders the consequenc­es will be extremely serious.”

Daniel must stay away from his two former partners for five years and was fined £400 and banned from driving for 10 months for driving while disqualifi­ed.
