Court orders arrest of abusive ex in ‘kill’ threat

A DAD who threatened to kill his ex, after catching another man at her home, has been found guilty of breaching a court order made to protect her.

Marcus Folan stormed round to the victim’s Crosland Moor home and labelled her “a slag” before making the threat as he tried to kick the front door in.

The 34-year-old had denied repeatedly breaching his non-molestatio­n order but was found guilty following a trial at Kirklees Magistrate­s’ Court.

He failed to show up for the hearing but his brave victim did and magistrate­s issued a warrant for his arrest.

Folan had previously pleaded not guilty to three charges of breaching a non-molestatio­n order dated between August 12 last year and January 25 this year.

Prosecutor Robert Campbell said that the victim was granted the oneyear court order in June last year.

The terms included a ban on going within 100 metres of her home or to any property she resides in. But Folan was witnessed in her garden twice, on August 12 and 17. Then, in the middle of the night on January 25, he attended at the house again.

Mr Campbell said: “There was some shouting outside. He said: ‘I’ve seen a man inside your property, you slag – I’m going to kill you’!’”

This was followed by banging and kicking at the front door. Police were called and arrested Folan, of Haigh Street, in Lockwood, nearby.

The victim confirmed she was in a long-term relationsh­ip with Folan and they have children together.

She said that on August 12 she was in the garden with the children when she saw Folan’s stepfather.

She gave him a bag of his clothing then Folan appeared from the bottom of the garden and started speaking to the children.

Then, just five days later, she saw her ex again. She told magistrate­s: “Marcus’ brother came round and asked why none of the family could get in touch with me, as I’d changed my number.

“He asked to speak to the children so I let them at the door.

“Marcus appeared again in my garden and shouted over from the bottom of my garden: ‘I love you, girls’. I closed the door and locked it behind me.”

Of the most recent incident when he came round late at night, she said: “I heard Marcus shouting outside, saying that he’d seen another man inside my property.

“He said he was done now and going to kill me.

“He was being abusive, shouting and swearing, and I could tell it was him by his voice.

“He left and I called police.

“As I was on the phone, he tried my door handle.”

Magistrate­s found the matter proved against Folan, and issued a warrant for his arrest not backed by bail.

Mr Campbell said that the bench at his sentencing hearing will be asked to make an indefinite restrainin­g order to replace the non-molestatio­n order, which is about to expire.
