Gaining more penality points leads to a ban for driver

A MISSED payment for car insurance has resulted in a Ballinamal­lard man being disqualifi­ed from driving.

It was heard at Enniskille­n Magistrate­s Court on Monday how police in Enniskille­n before 7.30pm on August 6 stopped a Toyota Corolla at the Irvinestow­n Road.

It was being driven by Mark Weir (28), with an address of Makenny Crescent, Ballinamal­lard, who was the owner of the car.

Police could not identify an insurance policy for the car and Weir was unable to produce one.

His solicitor, Garry

Smyth, told the court there had been a policy in place but a missed payment cancelled it. He said once this was realised, Weir took steps to remedy the situation.

Mr. Smyth said Weir was an “industriou­s” young man in gainful employment and his licence was vital to him.

The court heard how since 2016 Weir had been disqualifi­ed from driving on two occasions, and also received penalty points for no insurance.

Mr. Smyth accepted Weir had put himself in a very difficult position.

District Judge Steven Keown told Mr. Smyth there was very little to move him back from a nine-month disqualifi­cation.

But taking into considerat­ion Weir’s early plea, the impact the loss of his licence would have on his work, and all that was said on his behalf, he issued Weir with six penalty points and a £350 fine.

Due to the totting up of penalty points, this resulted in Weir receiving a six-month disqualifi­cation.
