Lout lashed out at cops helping him
A man who was found lying in a Paisley street turned abusive on cops who were trying to help him.
Boozed-up Thomas MacBain was lying on the pavement outside of The Northern Way in Paisley being aided by members of the public on August 7, 2021, when cops caught sight of him.
When the officers tried to help him, the 22-year-old refused to engage with them, became aggressive towards them and then tried to spit on an officer’s face.
Procurator fiscal depute, Michael Cunningham told Paisley Sheriff Court:“Around 7.30pm on Saturday, August 7, 2021, PC Andrews and McFedries were on uniformed mobile patrol in Paisley town centre.
“While driving along Causeyside Street, officers observed the accused lying on the ground outside of The Northern Way, being aided by two members of the public.
“On checking the accused’s welfare, it became apparent to the officers the accused was under the influence of alcohol.
“Officers tried to engage with MacBain but he didn’t respond and so PC Andrews kneeled down to check on him when MacBain started to act aggressively.
“Both officers tried to place handcuffs on MacBain however he continued to struggle with officers to avoid the handcuffs being put on him while repeatedly shouting,‘F**k off you bunch of c***s, go f ***** g do one idiots.’
“MacBain was instructed to stop shouting at which time he spat at PC Andrews face, narrowly avoiding making contact.
“The accused continued to shout and swear at officers, repeatedly making threats to kill them stating, ‘I’m going to kill you all ya bunch of c***s.’
“Due to his unsteady behaviour, MacBain was taken in an ambulance to the Royal Alexandra Hospital where he was assessed.
“He was later deemed fit to be released without any medication and at 10.20pm he was cautioned and charged and made no reply.”
MacBain admitted shouting, swearing, acting in an aggressive manner and making threats of violence towards police officers in August 2021. He also admitted spitting at PC Nicolle Andrews.
Defence agent Mr Stewart asked for reports to be called for given MacBain’s lack of offending history.
Sheriff Gillian Craig said:“You’re a young man with no previous convictions but this was quite disgraceful behaviour on the night in question.”
Sentence was deferred until June 27, for the preparation of a criminal justice social work report and a restriction of liberty order assessment.
MacBain, of Victoria Terrace in Ardrishaig, Argyll and Bute had his bail order continued meantime.
